Terms and Conditions

1. General
1.1  SIGHTANDSOUND is the trading name of Viddy Co. Limited (company number 06630077) whose registered office is at, 21 St Thomas St, Bristol, BS1 6JS, and any reference to 'Us' 'We' or 'Our' is a reference to SIGHTANDSOUND

1.2 Any reference in these terms and conditions to 'Customer', 'You' or 'Your' is a reference to the person (which includes a corporate or unincorporated body) who places and order to purchase products which is accepted by Us.

1.3 SIGHTANDSOUND are a company that provide high quality branded goods. The Customer is guaranteed to be supplied in the most efficient manner possible at realistic prices, without any hidden extra charges or small print.

1.4  The following terms and conditions apply to all transactions carried out by SIGHTANDSOUND via the telephone, Internet, mail and email. When placing an order using these methods it constitutes Your acceptance of these terms and conditions of sale. Please read them carefully. These terms and conditions do not affect Your legal rights under law. If You wish to know Your rights under law, then please contact your nearest Citizens Advice Bureau

1.5. The placing of an order by the Customer is an offer to purchase the products subject to these terms and conditions.

1.6. No contract exists between SIGHTANDSOUND and You until SIGHTANDSOUND has received and accepted Your order and sent to You a confirmation email. For the avoidance of doubt, these terms and conditions shall be incorporated into any contract between SIGHTANDSOUND and You.

2.Description of Goods

2.1 All products sold are of a technical nature and We are sometimes unable to give full specifications of all products. All images, descriptive matter, specifications in Our advertisements, relayed by telephone and/or on Our website (www.sightandsounduk.com)  are for the sole purpose of giving an approximate description of the product, and therefore the product delivered may differ from the image shown in Our catalogue and/or on Our website. If You are in any doubt, full specifications should be available from  the manufacturer.

2.2 Where We agree to source special order items (being any product which We do not regularly stock or sell) then because the item will have been ordered especially for You, SIGHTANDSOUND shall not be liable to accept the return of the special order item, or provide a refund, unless the special order item is faulty, or the provisions of clause 7 apply. This does not Your legal rights under law.

3. Product / Pricing Information
3.1 All product specifications, images and other information published by SIGHTANDSOUND have been made accessible by suppliers, manufacturers and publications. SIGHTANDSOUND cannot guarantee the reliability or accuracy of the information and prices described, published or quoted. Every effort is made by SIGHTANDSOUND to ensure that the prices shown in its current catalogue or on its website are accurate. If any error is found which effects Your order, We will inform You as soon as possible and offer You the option of reconfirming the order at the correct price, or cancelling the order. If You cancel Your order under this clause 3.1 We will refund or re-credit You for any sum which You have paid  or which has been debited from Your credit card for the product in question. In the event that a product is listed/published or quoted at an incorrect price, due to an error from our suppliers or publishers, We reserve the right to refuse any orders listed at the incorrect price. This  does not affect Your legal rights under law 
3.2 All prices quoted on Our website are inclusive of VAT and include free delivery (except in the circumstances detailed in clause 7  of these terms and conditions where a delivery charge will apply)
3.3 Stands for TVs, flat panels and HIFI equipment are usually flat packed for self assembly, by the Customer.
3.4 We advise customers to keep their boxes and packaging in the event that the products need to be returned to SIGHTANDSOUND.

4. Availability

4.1 All products and services are subject to availability and may be withdrawn at any time. If the products are not available within a reasonable period of time, We may offer a similar product or will refund the Customer if the transaction is cancelled. We shall not be liable for any losses, costs, damages, charges, or any expenses caused by any delay in the delivery of the goods if they are delivered in a reasonable period of time.

5. Payment

5.1 SIGHTANDSOUND accepts all major credit/debit cards including Visa, MasterCard and Switch, with the exception of American Express. The Customer must provide Us with the Customer's exact billing address and telephone number, which is held with the Customer's credit/debit card company. Any incorrect information given could cause delays in processing the Customer's order, which SIGHTANDSOUND will not accept responsibility for.

5.2 Please note that the Customer's order will be processed only once an authorisation code has been received from Your credit/debit card company, or cleared funds have been received by Us.

5.3 Cheques and postal orders will take a minimum of 10 days from receipt of the same, until the payment has cleared. The products can then be released for dispatch.

5.4 SIGHTANDSOUND reserve the right to charge a minimum of 2.5 per cent of the price for credit card transactions.

6. Data Protection
6.1 We will take all reasonable precautions to keep the details of the Customer's order and payment secure. In addition any correspondence recieved by SIGHTANDSOUND or You in any durable format shall be treated as confidential and are for sole use of the intended recipient.

7. Delivery
7.1 Delivery of all products, which are available in stock, will be completed by Our nominated couriers to the address provided by the Customer when placing the order. Please note that products will not be left unless they have been signed for by an adult aged 18 years or over.

7.2 Every effort will be made to deliver the products as soon as possible after payment has been received by Us in cleared funds, and in any event within 30 days thereof, however We will not be liable for any loss of damaged suffered by the Customer through any reasonable or unavoidable delay in delivery.

7.3 Large or heavy products may be delivered using a 2-man delivery service. The delivery time for such items may take between 5-7 working days (being any day other than a Saturday, Sunday or public holiday in the UK) after the payment for the item as cleared.

7.4 SIGHTANDSOUND reserve the right to charge a surcharge of 35 per cent to the  Customer if we are unable to deliver the products and a re-delivery is needed.
7.5 In remote areas of mainland UK (to be determined by SIGHTANDSOUND) delivery may be subject to delays and surcharges. If in doubt, please check with Us at point of order.

7.6 Due to government legislations regarding inner city congestion, any additional costs incurred by US, or our nominated couriers, may be levied back to You. This includes delivery, collections and engineer call outs. Please call Us for more information.

8. Shipping
8.1 Please be aware that SIGHTANDSOUND, at present, only deliver to mainland U.K. 

9.  Acceptance & Risk
9.1 Once the products have been delivered and accepted by the Customer, the products become the sole responsibility of the Customer. SIGHTANDSOUND will not be responsible for any loss or damage to the products after acceptance of the products by the Customer.
9.2 Any incomplete orders or damaged products should be returned to SIGHTANDSOUND at the customers own cost and also noted on the delivery consignment note at the time of delivery, as this may prejudice your claim, if You do not.

10. Notification of Claims
10.1 Any shortages, damages or incorrect products received must be reported to SIGHTANDSOUND immediately on receipt. Any delay in reporting, may prejudice Your claim.

11. Product Guarantees
11.1 All products supplied are covered by the terms and conditions of the manufacturers guarantee, which are stipulated within the guarantee period.
11.2 Products with a limited life span carry a 3 month guarantee i.e. batteries, memory cards. This guarantee specifically excludes faults by accident, neglect or misuse of the product.
11.3  Routine maintenance including tuning of channels, convergence and control of any user interface are not covered under the manufacturers guarantee.
11.4  SIGHTANDSOUND, reserve the right to charge the Customer carriage and an administration fee, up to the value of 75 pounds, in the event that products that are returned 'faulty' by the customer and that are found to be working to the manufacturers specification or within the manufacturers tolerance levels.

12. Under Guarantee Repairs
12.1 All products that develop faults within 28 days from receipt, should be reported to SIGHTANDSOUND within the 28 day period from when the products are received and accepted by the Customer. This does not affect Your legal rights under law.

12.2 All items that fall within the manufacturers guarantee period, must be returned to SIGHTANDSOUND at the Customer's cost or alternatively SIGHTANDSOUND may wish to collect the goods. SIGHTANDSOUND will then test the products to confirm the fault and either offer a full refund(providing the request for a refund is made within a reasonable timeframe of 28 days of receipt off the goods), including the customers reasonable carriage charges, or return the faulty products for repair or replacement to the manufacturer.
12.3 Where possible SIGHTANDSOUND will give timescales for repair to the faulty products, if this information is available from the repair agent or the manufacturer. Please be aware that this can be upto 21 days.

12.4 Were possible, We advise all Customers to package the products for return, in the original box and packaging material. In the event the products are packaged in a negligent manner, using alternate packaging, then the Customer will be responsible for the damage that may be sustained during transit.
12.5 SIGHTANDSOUND will contact the Customer and provide the Customer with a returns address and reference number for annotation on the packaging of the unit.

12.6 Products that are found to be working to manufacturers specifications will be returned to the Customer. The total cost of carriage incurred by SIGHTANDSOUND and an administration fee of up to 25 pounds may be charged to Your account. Any returned  products refused to be accepted back by the Customer will also incur additional costs for re-stocking equal to 25 per cent of the invoice price of the products.

12.7 We advise our customers that all accessories should be unopened; including cabinets, remote controls, speaker wire, batteries and scart leads, any accessories missing from the returned product will incur an administration charge of 25 pounds, plus the replacement cost of the missing accessory, from the manufacturer.

13. Your right of cancellation.
13.1 If You are a person (any not a company or other legal entity) and You purchased the products for your own use, and not for use or resale in any business, then subject to complying with certain requirements set out in the Consumer Protection (Distance Selling) Regulations 2000 (as amended) then You may be entitled to cancel the contract between You and SIGHTANDSOUND for the sale and supply of the products. The remaining provisions of this clause 13 detail how You can cancel the contract, and the effect of cancellation.

13.2. You have the right to cancel the contract at any time up to the end of 7 working days, after you receive the products, and this is referred to as the Cancellation Period. For the purposes of this clause 13 'working days' means all other days other than Saturdays, Sundays and public holidays. In most cases, we will offer an extention to your rights under (Distance Selling) Regulations 2000 (as amended), of a further seven days (Being 14 days in total) from receipt of the goods.

13.3 To exercise Your right of cancellation, you must give written notice to Us by either hand, post, fax or email to the address, fax number or email address shown below, giving the detail of the product ordered within the Cancellation Period.. Please also state your customer account number (if applicable) and sale number. Please note that a telephone call is not sufficient to constitute a valid cancellation.

13.4. If you exercise your right of cancellation after the products have been delivered to You, You will be treated as having been under a duty throughout the period prior to the cancellation to retain possession of the products and to take reasonable care of them. You will also be responsible for returning the Products to Us, to the address shown below, and You will be responsible for the cost of retuning the products to Us. Where You return the products to us, you are under a duty to take reasonable care to see that the products are received by Us and are not damaged in transit. As such we would advise You to retain the original box and packaging materials provided with the product when it was delivered.

13.5 Once you have notified Us that you are cancelling the contract, We will refund or recredit You as soon as possible, and in an case within a period not exceeding 30 days beginning with the day on which Your notice of cancellation was given. We shall be entitled to deduct from any refund or recredit any charge We may make in recovering any product, which You have failed to return to Us under clause 13.4, or which You return to Us but at our cost.

13.6. If You cancel the contract, the effect of Your notice of cancellation is that the contract shall be treated as if it had not been made.

13.7. PLEASE NOTE that you will NOT have a right to cancel the contract if the products are audio or video recordings or computer softwear if they have been unsealed or for products which by their nature cannot be returned or are liable to determinate or expire rapidly.

13.8 PLEASE NOTE that any cancellation notice received after the expire of the Cancellation Period will not be valid to cancel the contract under the Consumer Protection (Distance Selling) Regulations 2000, but this does not affect any other right You may be entitled to under law.

14. Other
14.1 The Customer will take ownership of the goods from SIGHTANDSOUND once we have received Your payment in full.
14.2 The Customer will receive an invoice from SIGHTANDSOUND on receipt of the products. Any further copies required are available by emailing sales@sightandsounduk.com.
14.3 Failure by Us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.
14.4 These terms and conditions are subject to change at any time without prior notice and do not affect Your legal rights under law.

14.5 These terms and conditions (and for the avoidance of doubt the sale and supply of any products) will be governed by and subject to English law, and the English courts will have exclusive jurisdiction.
